IDOH issues guidance for new Indiana abortion law
On Sept. 8, 2022, Senate Enrolled Act 1 (SEA 1) changed Indiana’s abortion laws. The implementation of SEA 1 was halted by the Indiana courts on Sept. 22, 2022.

Earlier this month, the Indiana Supreme Court dissolved a preliminary injunction that had temporarily halted the implementation of SEA 1. Based on court rules, the ruling will allow SEA 1 to go into effect upon certification by the court, on or about Aug. 1, 2023.

A separate Indiana court case over SEA 1 that involves arguments concerning sincerely held religious beliefs is currently being litigated, but as of the time of this writing does not prevent the law from going into effect.

The Indiana Department of Health (IDOH) has issued Terminated Pregnancy Reports and SEA 1 Implementation guidance to assist physicians and nonphysician practitioners with the new law. Per the request of the IDOH, ISMA is sharing this guidance with its members.

If you have any questions about the new law or guidance, please contact the IDOH using the contact information in the guidance documents above.
