Navigating the MultiPlan Litigation: What Practitioners and Facilities Need to Know

Program description:

A sweeping federal antitrust lawsuit is moving forward against MultiPlan, Inc. and several major insurers, including Aetna, Cigna, UnitedHealth, and Blue Cross Blue Shield, alleging that MultiPlan, using Data iSight, Viant, and its other services, facilitated a horizontal price-fixing agreement among insurers that artificially suppressed out-of-network payment rates and cost providers billions of dollars. Following a key court ruling in June 2025, the case is headed into discovery, with potential damages tripled under federal law for successful claims. Participants will explore the litigation's origins, key legal developments, and strategies for affected providers to consider. The session will also examine why now is the time to evaluate potential participation on an individual, non-class basis, without waiting for a ruling on the proposed class action, which is expected no earlier than 2027.

About the speakers:

Matt Lavin, JD, and Jennifer Scullion, JD, are partners at Gilbert LLC and Seeger Weiss, respectively, and serve as members of the Executive Committee for direct action plaintiffs in the MultiPlan antitrust litigation. They represent hundreds of practitioners and facilities nationwide navigating the litigation and will walk attendees through what this case means for providers and what steps to consider next.
