BILL: HB 1113 – Birth Certificate Fraud

THIS WEEK: HB 1113 did not receive a hearing in the Senate Committee on Corrections, Criminal and Civil Matters this week.
HB 1113 increases the penalty for:
- Making a false statement when applying for a birth certificate
- Counterfeiting a certified copy of a birth certificate
- Using a counterfeit copy of a birth certificate from a Class A misdemeanor to a Class D felony
BILL: HB 1144 – Failure to Report a Dead Body

THIS WEEK: The Senate Committee on Corrections, Civil and Criminal Matters passed HB 1144 by a vote of 10-0. The ISMA spoke to the author about concerns that doctors could be charged with a criminal penalty if they do not report a person who died within the three-hour time frame. The bill was amended by the committee so it will not supersede current reporting procedures in place for health care providers. HB 1144 now moves the Senate for second reading amendments.
The bill would establish a Class A misdemeanor for a person who knowingly or intentionally fails to report within three hours the discovery of a dead body when it appears the deceased person died by violence, suicide, accident or under certain other suspicious or unusual circumstances. The report must be made to a public safety officer, coroner, physician or 911 telephone call center.
BILL: HB 1318 – Funding for Spinal Cord and Brain Injury Fund

THIS WEEK: HB 1318 was assigned to the Senate Committee on Homeland Security and Transportation & Veterans Affairs.
HB 1318 changes the funding for the spinal cord and brain injury fund from a $10 motorcycle
registration fee to a $.50 fee on passenger motor vehicles, motorcycles, trucks, buses and RVs.
The bill makes technical changes to the fund and increases the law enforcement continuing education program fee from $3 to $4.
