BILL: SB 3 Dispensing Drugs by a Pharmacist

ISMA POSITION: Neutral with concerns
THIS WEEK: Last week the Senate Health and Provider Services Committee considered testimony on SB 3. This bill provides that a pharmacist would not be required to fill a prescription if he/she believes it would cause an abortion, destroy an unborn child or cause the death of a person by means of assisted suicide.
The ISMA is concerned that, as written, the bill could apply to oral contraceptives and high doses of certain pain medications. Amendments have been proposed that would clarify these concerns, but no vote has been taken on the amendments as of press time.
The ISMA will request that the bill be amended to require that a pharmacist refusing to fill a prescription contact the prescribing physician within 24 hours of refusal, refer the patient to a pharmacy that will fill the prescription and give the patient back the refused prescription.
